1. Purpose and Scope

The purpose of these Terms of Service is to define the terms and conditions under which users (hereinafter the "User" or "Users") access and use the website hosted on the Shopify platform (hereinafter the "Site") and operated by Alexander Ward (EI - Savon De La Chaume).

Any browsing of the Site, as well as the creation of a customer account, implies express acceptance, without reservation or restriction, of these Terms of Service. If the User does not accept the terms of these Terms of Service, they are requested not to use the Site.

2. Legal Notice and Hosting

The Site is published by Alexander Ward, a sole trader operating under the trade name Savon De La Chaume. For any questions or complaints regarding the Site, the User may contact the publisher at the following email address: contact@savon-de-la-chaume.com.

The Site is hosted by Shopify Inc., located at 151 O'Connor Street, Ground Floor, Ottawa, Ontario K2P 2L8, Canada.

3. Access to the Site and Creation of a Customer Account

The Site is freely accessible to any User with Internet access. All costs associated with accessing the Site (hardware, software, and Internet access fees) are borne exclusively by the User.

3.1 Authentication and account creation procedures

To access certain features—such as simplified ordering and purchase history tracking—the User may access a customer area. Authentication on the Site is managed via the secure solution provided by the Shopify platform:

  • Passwordless login: The default login method involves sending a one-time verification code (6 digits) to the email address provided by the User. There is no need to complete a prior registration process involving the creation of a password.
  • Automatic profile creation: If the User authenticates using an email address not yet registered in the Site's database, a customer account and user profile are automatically generated based on that address.
  • Login via the Shop application (Shop Pay / Sign in with Shop): Users who have a Shop account with Shopify Inc. may authenticate directly via this third-party service to expedite the login and checkout process. Use of the Shop service is subject to Shopify Inc.'s own terms of use and privacy policy.

3.2 User Obligations and Liability

  • The User warrants that they are of legal age (18 years or older) or possess the legal capacity to enter into binding agreements.
  • The User agrees to provide accurate, complete, and up-to-date information (including a valid email address).
  • The User is solely responsible for the confidentiality and security of access to their email account and their Shop account. Any action performed via their customer access is deemed to have been carried out by the User themselves.
  • In the event of unauthorised use or suspected compromise of their access credentials, the User must immediately notify Savon De La Chaume at contact@savon-de-la-chaume.com.

4. Account Closure and Suspension

The User may request the deletion of their customer account at any time by sending an email to contact@savon-de-la-chaume.com.

Savon De La Chaume reserves the right to suspend or terminate a User's account, automatically and without prior notice, for a legitimate reason, including but not limited to:

  • Failure to comply with these Terms of Use or the Site's rules of conduct;
  • Provision of false or misleading identification details;
  • Fraudulent activities, hacking attempts, or misuse of the Site's features;
  • Payment failure or issues regarding previous orders.

5. Prohibited Use and Rules of Conduct

The User agrees to use the Site in compliance with applicable laws and regulations. The following are strictly prohibited on the Site:

  • Any illegal, fraudulent, abusive, defamatory, obscene, or hateful behavior;
  • Automated data extraction (scraping, web crawling), harvesting, or scraping of the Site's content without prior written authorization;
  • The introduction or transmission of viruses, computer worms, or any other malicious or destructive code;
  • Any attempt to compromise the security, integrity, or proper functioning of the Site's technical infrastructure or Shopify's servers;
  • Impersonating a third party or using a false email address.

6. Intellectual Property

All content appearing on the website savon-de-la-chaume.com—including, but not limited to, text, photographs, visuals, logos, illustrations, videos, graphic designs, icons, and audio elements—is the exclusive property of Alexander Ward / Savon De La Chaume, unless otherwise specified. These elements are protected by French and international copyright and intellectual property laws.

Any reproduction, extraction, modification, distribution, adaptation, or reuse—whether in whole or in part—of any element of the site, by any means or process whatsoever, is strictly prohibited without the prior written consent of Alexander Ward.

Any unauthorized use or exploitation of the site or its content will be considered an act of infringement (in accordance with Articles L. 335-2 et seq. of the Intellectual Property Code) and may result in legal action.

7. Characteristics of Artisanal Products and Recommendations for Use

Savon De La Chaume offers cosmetics (handcrafted soaps) and handcrafted wooden items (soap dishes, accessories) for sale:

7.1 Handcrafted variations: As the products are handmade using artisanal methods, legitimate variations in shape, color, marbling, wood grain patterns, or weight may occur between batches or individual items. These natural variations do not affect the intrinsic quality of the products and shall not be considered defects regarding conformity.

7.2 Precautions for use and allergens: The full composition of each cosmetic product (INCI list) is provided on the corresponding product page. It is the User's responsibility to review the list of ingredients prior to purchase and use, particularly in cases of known sensitivities or allergies (especially to essential oils).

7.3 Product storage: To ensure the longevity and quality of the soaps and wooden items, Users are advised to follow the recommended storage guidelines (e.g., allowing the soap to dry on a draining soap dish between uses and avoiding prolonged exposure to standing water).

8. Customer Reviews, Comments, and Contributions

If the Site allows Users to post reviews, comments, or suggestions:

  • The User grants Savon De La Chaume a non-exclusive, royalty-free, worldwide right—valid for the statutory duration of copyright—to use, reproduce, modify, adapt, and publish said comments on the Site and across its communication channels.
  • The User warrants that their contributions do not infringe upon any third-party rights (such as copyright, image rights, or privacy rights) and do not contain any unlawful or defamatory content.
  • Savon De La Chaume reserves the right to moderate, reject, or remove any review or comment that does not comply with these Terms of Use or applicable regulations.

9. Third-Party Services and Hyperlinks

The Site may contain hyperlinks to websites or resources managed by third parties (such as social networks or third-party application modules). Savon De La Chaume exercises no control over the content or practices of these third-party sites and disclaims all liability regarding their access, content, or use.

The use of optional tools offered by third parties via the Site (e.g., secure payment solutions, shipping modules, Shop authentication) is the sole responsibility of the User and remains subject to the respective contractual terms of these third-party providers.

10. Site Availability and Limitation of Technical Liability

Savon De La Chaume employs all reasonable means at its disposal to ensure high-quality, continuous access to the Site (obligation of means). However, access to the Site may be temporarily interrupted, suspended, or restricted without notice for maintenance, updates, infrastructure improvements, or due to malfunctions related to the Internet network or the servers of the hosting provider, Shopify.

Savon De La Chaume shall not be held liable for any direct or indirect damages resulting from:

  • An interruption or temporary unavailability of the Site or the Shopify platform;
  • Technical incompatibilities between the Site and the User's computer equipment or software;
  • The unforeseen presence of bugs, viruses, or malware beyond the reasonable control of the publisher.

11. Personal Data and Cookies

In connection with the use of the Site and the management of customer accounts (including authentication via email or Shop), Savon De La Chaume collects and processes personal data concerning the User, in accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act (*Loi Informatique et Libertés*).

13. Governing Law and Jurisdiction

These Terms of Service are governed by, interpreted in accordance with, and subject to French law.

In the event of a dispute regarding the validity, interpretation, or performance of these Terms of Service, the User and Savon De La Chaume agree to seek an amicable solution as a first step.

The User may contact Savon De La Chaume in writing at contact@savon-de-la-chaume.com. Failing an amicable resolution, the dispute shall be subject to the exclusive jurisdiction of the competent French courts.
